Apparantely, McKay said the horse had nothing left and he was trying to hold him up to get the trip. He wasnt banned on the basis that when he whipped the horse he did not run on and only finished 1 1/2 length clear of the third. The fact that the horse had no chance to respond to the whip was irrelevant apparantely.
